Below we have summarised the current Planning Applications in the Wilsden Parish Council. When an application has been accepted by Bradford Council Planning Department they will immediately consult the Parish Council who have to respond within 21 days. Within about one week the Parish Clerk will decide the date of the meeting that will consider this application. The Parish Council meeting is open all and if residents wish to speak about a particular application, whether they are for or against, this will generally be allowed. Once the Parish Council has decided whether they support or oppose an application the table below will be updated and Bradford Planning Department will be notified of the decision. The Parish Council has the option of requesting that a particular application is considered by the Shipley Planning Panel or is decided by a Planning Officer. The updated comments submitted by the applicant have been noted but they don't address the given safety issues and neither do they address the other concerns raised by Wilsden Parish Council. Wilsden Parish Council does not support this application. We have major concerns about fire safety and note that whilst the applicant has produced a Laneside Fire Strategy Plan these is no evidence of the Fire and Rescue Service having been directly consulted. We recognise that, based upon evidence of the operation of BESS in the UK, the likelihood of fire is extremely low but it should be recognised if a fire does take place it has an extremely high impact both in terms of the risk to neighbouring houses and the pollution risk to Wilsden Beck. In the event that a fire does breakout in a BESS this will rapidly develop into a major incident and result in significant volumes of hazardous chemicals such as Hydrofluoric Acid being generated. Springs in the area are one of the sources for Wilsden Beck and unconstrained runoff from any incident would result in a major pollution incident downstream through Wilsden Beck to Harden Bek and to the River Aire.In addition to our fire safety concerns we also do not believe this application meets the very special circumstances test that is required for approval of a development within the Green Belt. Paragraph 160 of the NPPF states that “When located in the Green Belt, elements of many renewable energy projects will comprise inappropriate development. In such cases developers will need to demonstrate very special circumstances if projects are to proceed. Such very special circumstances may include the wider environmental benefits associated with increased production of energy from renewable sources.” We accept that there are very special circumstances associated with the development of BESS associated with the Bradford West Electricity substation but these circumstances are not necessarily associated with this site. The closeness of this site to Laneside, which is viewed as a strong and defensible boundary to the Wilsden Settlement Boundary, results in a significantly greater perception of urban sprawl than is the case for other BESS proposals.This is the fourth BESS linked to the Bradford West substation and Wilsden Parish Council has recently received a pre-application consultation for a fifth project linked to the substation. We are concerned that all these applications are being considered on an individual basis purely based upon the timing of the planning application. No advice is given in the application on the short and long term energy storage requirement for Bradford to ensure the effective operation of the substation, when all the electricity is from renewable sources. Two BESS have already been approved and are being constructed and there are three other potential sites under consideration. We would request that, before any other systems are approved, the overall storage need is established. Given that proximity to the substation will minimise energy losses during operation as well minimising the loss of Green Belt land and disruption during construction this should be a material factor when considering approval. We would recommend that distance from the substation is a criteria if the energy storage need is lower than the cumulative capacity of all the applications submitted.Decision - Grant subject to Unilateral Undertaking

any new development should meet the conditions of para 154 of the NPPF. The application is
described as an Agricultural building with storage and stable facilities but we found no evidence of
the proposed development being designed for agricultural use. The development appears to be
designed as stabling for horses and not for agricultural purposes.
While we appreciate horse riding would qualify as an outdoor sport and therefore might be
considered as suitable for a new development in the Green Belt no justification is given for the
need for new stabling facilities. A significant number of the existing agricultural buildings in the
Wilsden area are now devoted to the stabling of horses and new stabling has been approved
associated with the historic farm buildings. This application is for a standalone building in a
location where no previous development has previously taken place. The proposed development
would adversely affect the openness of the Green Belt and be an inappropriate development at
this location.
We therefore concluded that this application is contrary to the principles for safeguarding the
Green Belt as detailed in the NPPF.

We do not have an objection to the subdivision of the existing residential units to create an increased number of units we have concerns about the proposals here. Bents Mill was one of the earliest textile mills in this area and was unusual in that it processed cotton rather than wool. When the original conversion to residential use was completed the water wheel, mill pond and water courses were retained and as the Bradford Conservation Officers report states it has high heritage significance. The Heritage Statement gives minimal detail of the impact of proposed work and we were particularly concerned with the statement “that the Applicant has the desire to fill in the existing hole located at the ground floor of unit 1 if possible. It is not clear why this previous part of the Mill has been retained, but it is proposed to use this space as residential floorspace instead. The preference is to fill in this existing void which serves no purpose to in turn provide a suspended floor and additional living space.” The existing plans clearly show this space in the ground floor of unit 1 is a viewing area for the water wheel. Bents House is a non-designated heritage asset within the emerging Wilsden Neighbourhood Plan and an important part of the Hallas Bridge Special Character Area. Whilst we do not have the date when the house was built it was occupied by the owner of Bents Mill from 1805 and the conservation of the character of the house is very important for this part of the Wilsden Parish Council area.

Bents Mill was one of the earliest textile mills in this area and was unusual in that it processed cotton rather than wool. When the original conversion to residential use was completed the water wheel, mill pond and water courses were retained and as the Bradford Conservation Officers report states it has high heritage significance. The Heritage Statement gives minimal detail of the impact of proposed work and we were particularly concerned with the statement “that the Applicant has the desire to fill in the existing hole located at the ground floor of unit 1 if possible. It is not clear why this previous part of the Mill has been retained, but it is proposed to use this space as residential floorspace instead. The preference is to fill in this existing void which serves no purpose to in turn provide a suspended floor and additional living space.” The existing plans clearly show this space in the ground floor of unit 1 is a viewing area for the water wheel. The Parish Council assumes that if this application for change of use is not granted that the use of the residential caravan will also cease.

The Design and Access Statement refers to the site as previously developed land but Policy SC5 of the Bradford Core Strategy refers to a preference for development of previously developed only within the existing settlement boundaries. The quarry has been disused for more than a century and was identified by the Parish Council, in conjunction with the West Yorkshire Ecology Service, as an important heathland wildlife corridor in the emerging Wilsden Neighbourhood Plan. In the absence of a detailed ecological survey this application should refused as a result of its adverse impact on the biodiversity of the area. The Parish Council also note that Design and Access Statement states that the pods will be screened by fast growing hedging without giving details of the species in the absence of evidence to the contrary it believes that the inclusion of this hedging is likely to have an adverse impact on the biodiversity.

As the application makes clear these buildings have not been used for agricultural purposes for many years but have been used for industrial purposes to store building materials and equipment. The building was originally approved in 2010 for storage of food and equipment associated with farming suckling cows but there has been no visual evidence of this taking place for many years. The outside storage area, which was originally approved as a menage in 2009 has never been used for agricultural development.

The Parish Council have two specific concerns about this development, firstly the lack of evidence that there is any intention to address the issues of sustainability and energy. There is no evidence the applicant has addressed the terms of para 155 of the NPPF by installing solar panels, providing efficient and effective insulation. Details of an appropriate approach can be seen in the emerging Wilsden Design Code and specifically code 1A.

The Parish Council’s second concern relates to the design and specifically the materials of construction. The structural report describes the building as being of no architectural merit a sentiment with which we would concur. The proposed materials are not normally in character with the area for residential properties with buildings being typically of Yorkshire stone with slate roofs. However, exceptional design and build quality with high sustainability may be considered. Examples of materials and detailing are given in Code 3C of the emerging Wilsden Design Code.

Based upon the above concerns and the recommendations of para 134 of the NPPF we would submit that this application should be refused.

The Parish Council is also surprised and concerned that the calculated Biodiversity Net Gain for this significant development in the Green Belt consists of the installation of one bat box and one swift nest box.

There is also a potential adverse environmental impact. The application states that the whole site is 2.2 acres but does not say that 30% is protected woodland covered by a TPO. If potential damage is to be avoided the protected woodland must be securely separated from the open area. The applicant has stated that he wishes to keep horses on the land, but the Parish Council is concerned that the lack of visual oversight of the site and proximity to Harden Lane is problematic to the welfare of the horses and the security of animals and tack. The site is also fairly distant from the applicant’s home and would require vehicular visits so is also poor in sustainability. 

In the couple of years since the applicant purchased the site, he has cleared the 20 years-worth of scrubland and self-seeded trees and tipped hard-core and topsoil onto the land thereby significantly reducing the biodiversity of the site and its visual and environmental amenity. This has also raised the land level such that the existing dry stone walls bordering Harden Lane are now too low to prevent horses escaping onto the main road. While the Parish Council, if the application were to be granted, accepts the proposal for a fence round the menage, this would not be appropriate for the boundary with Harden Lane which should remain as a drystone wall raised in height and would further suggest that a dry stone wall should be built to prevent access of the horses to the protected woodland.

Wilsden Parish Council supports the principle of the reuse of redundant agricultural building but cannot support the significant over development proposed for this application.

The intent to convert every built structure on the site to a residence results in some low and cramped living spaces, and some with no designated garden.

The former kennels (probably built around 1976) are extremely dilapidated, roof fallen in, single skin breeze block wall breaking down (not shown on any of the applicants photos). Their simple construction, form, size and materials would not translate well to housing nor do they relate well to the vernacular of the old stone farmhouse and barns.

Works to make the old kennels habitable would be detrimental to the openness of the green belt. Demolition and clearance of these buildings appears to be the only suitable option.

The increase in volume of the garage/pigsties would also be detrimental to the openness of the green belt. These structures are on the corner of the junction of footpaths Bingley 245 and 193 and are prominent in the landscape. They are relatively new structures, on the 1955 OS map only the main farmhouse and Laithe, the abutting barn to the north and the detached small storage barn to the south of the site are shown.

Similarly, the proposed extension of the farmhouse extends the building out of its current curtilage projecting further into the field. It significantly increases the volume and mass of the building.

The barn which abuts the farmhouse has a rear roof which meets awkwardly with the northern wall of the laithe. According to the surveyor’s report, this wall has a bulge which necessitates some rebuilding, giving an opportunity for consideration as to how these two built forms might better relate to each other and how light gets into each of them.

The multiple rooflights in the roof of the old laithe are an incongruent addition which breaks up the characterful coverage of the stone slates.

The Parish Council concurs with the concerns of the drainage officer about the surface water drainage into the pond and asks for clarity in how the extra water will drain out of the pond. at present footpath Bingley 245 (downgraded from bridleway status) is extremely wet in the area of New Laith Farm. Increasing the flow of water towards the pond adjoining the footpath is likely to worsen this problem.

22/05069/PAR Proposal: Change of use of agricultural building and land to one dwelling (C3) and associated building operations

3rd January 20239th January 2023Wilsden Parish Council objects to this application for the following reasons:

The applicant wishes to use Class Q to allow the conversion of an agricultural building to a dwellinghouse.

The building was not on the land on 20 June 2012 when the applicant's appeal (12/00004/APPFUL) was dismissed. The application had been to build eight stables on the land. The Parish Council is unable to say when exactly the building was erected. There was no planning permission or PNR obtained. If the building was erected as an agricultural building under Permitted development rights then that would have extinguished the right to convert it under Class Q.

The building was used for equestrian purposes and this not only precludes the use of Class Q now but also was unlawful from the start, although enforcement action was not taken.

The Parish Council queries whether the building is/was in use as part of "an established agricultural unit". The smallholding was used for the stabling of horses and a small flock of sheep.
A development is not permitted by Class Q if the site was not used solely for an agricultural use as part of an established agricultural unit on 20th March 2013.

Change in the external appearance of the building (i.e. timber cladding as stated in the design statement) does not come under Class Q.

The location of the building is such that it is the sole building on the southern and eastern side of the bridleway. The introduction of domestic elements and curtilage for garden, driveway, boundary treatments etc. would harmfully erode the openness of the green belt.
It would be therefore be undesirable for the building to change from agricultural use to a use falling within Class C3 (dwellinghouses) of the Schedule to the Use Classes Order and so precludes the use of Class Q.

The applicant has recently received permission (21/00979/PAR) under Class Q to convert two buildings at the western side of the farm track (bridleway Bingley 165). This should not be taken as a precedent for the current application.

The bridleway, which is unmade, narrow and turns a 90o corner immediately prior to the gateway, has had little to no vehicular traffic with the exception of the applicant travelling along and back twice a day. The increase in traffic along this track, which is a well-used part of the Calder-Aire Link, when considering both the granted application and the current application will therefore be a great deal higher than previously and be detrimental to the safety of the horses and riders, cyclists and pedestrians using it

This application is for a building which is likely to be still needed if the applicant continues to hold any livestock or keep agricultural machinery or feed on his smallholding as all other buildings on the applicant's land are destined for conversion in the granted 21/00979/PAR.

The opinion of Wilsden Parish Council is that this application cannot be considered a class Q conversion and that a full planning application is necessary.
Application Refused
22/05010/MAFProposal: The proposed energy storage facility would accommodate up to 108 battery storage cabinets, arranged in 18 clusters of 6 units, along with ancillary structures including a connection building, substation building, site office and storage unit. The site would be surrounded by security fencing and a significant area of new peripheral landscaping. The project would provide rapid-response electrical back up the electricity network in the form of frequency response support, reactive power support and synthetic inertia.

3rd January 20239th January 2023Wilsden Parish Council does not support this application.

The Parish Council accepts that there is a national need for energy storage, and a previous application for a 50mW array of 50 batteries at Bradford West substation has already been granted (18/03894/OUT and 19/03074/REM) on an adjacent site.

The current application is for a 100mW storage facility on two fields in the green belt to the east of the substation. This would make the battery storage at Bradford West among the largest of the National Grid's 330 high voltage substations.

It would extend the sprawl of the substation a considerable distance into the green belt harming its quality and distinctiveness. With a projected lifespan of 50 years, this decision will impact upon future generations.

The Parish Council is concerned that, due to the lack of an overall body regulating the building of energy storage, the large number of energy supply companies will be seeking to insure against blackouts by each having their own battery storage units across the National Grid.

It is the opinion of the Parish Council that this application is poorly designed.
It achieves only 100mW on a site of 2.1ha (c.f. 50mW on 0.8ha on the previously granted site).
The proposed site is inadequately screened with 80% of the trees being small 'feathers' and the remaining 20% 'up to 3m' in height. The planting scheme is only a thin line of trees at 1.5m intervals around the boundary. For five to six months every year the native trees will be leafless and offer no screening at all.

The application suggests that 'creation of larger areas of woodland was considered inappropriate given the open field pattern of the host landscape'. The Parish Council is taking active measures, having declared a Climate emergency, to increase woodland across the Parish and beyond. The applicant's photos from VP3 show that, besides the trees associated with the substation compound, there is woodland on the hill behind.
The proposed site should be surrounded on all sides by a thick belt of woodland including holly as well as broadleaf. The northern and eastern sides should have naturalistic margins to look like natural woodland. This would help prevent the proliferation of more energy storage schemes or other National Grid support apparatus encroaching further upon the green belt. Larger, more mature trees than 3 metres should be planted and at a much greater ratio than 1 in 5.

The Parish Council notes that the height of the proposed building to house the switchgear is 10.6m. This height and mass are an alien and dominant intrusion into the landscape. Grey colouring for the top part of the building will make it more visible.
The use of engineered red brick for the electrical control room is uncharacteristic of the area.

While the Acoustic Design Assessment concludes that 'the proposed installation would not have a significant adverse impact on any neighbouring properties' and that 'levels would be below the British Standard 8233 guidelines for residential occupation during both the day and night' it is likely that noise would be noticeable by residents in the vicinity and impact adversely on their amenity. The battery cooling fans are more likely to be deployed in hot weather when residents have their windows open. A light prevailing wind would carry sound towards houses to the north at New Holland, Honey Pot and Lane Side. Furthermore because the area is open countryside there is little to no background traffic noise or ambient urban noise so intermittent use of the fans would be more noticeable especially during the night-time.

There has so far been only one fire at a battery storage site, but there is no detail in the application as to how run off from the site in the event of a fire would be prevented from entering the watercourse at the north-east of the site or of pollutants being washed off the site following such an incident or leakage.

If this application is granted, conditions on creating surrounding native woodland to form adequate 360 degree screening must be imposed.
The density of batteries must be such that the most frugal use of green belt land can be achieved.
Careful consideration should be given to how the number of energy companies benefitting from this application can be maximised to mitigate against future energy storage applications at this substation.
Acoustic testing of expected noise levels must be done to properly assess the impact on residents.
